That is a good question !

Joe, the graphic seems to violate several sections of Title VII related to job-training, the printing of notices, images, advertisements, etc. An employee would have reason to report the graphic as violations of those sections. And there is an aspect of Title VII which protects employees against retaliation by their employers for such reporting.
And yet, these days, the virtue of prudence makes her case: the employee might reasonably doubt that the protection element will be enforced, and thus the employee might choose to remain silent for the sake of prudence – especially if the employee has financial obligations to family, etc.
Bill, this looks like an example of the conflict between the virtues of courage and prudence. You’ve addressed this point several times over the years. Courage (not to mention justice and self-respect) calls for reporting the violation, and yet prudence advises self-restraint and sagacious silence, at least for now. -

There’s a curious bit of irony to consider in this story, though I find the irony unsettling rather than amusing.
Folks who work in academia and in the corporate world are likely to take annual ‘compliance training’ courses on Title VII and related topics. These courses explain the purpose and content of Title VII and provide examples of its violation — often via actors who perform a series of skits to illustrate various violations. I suspect employees at IBM have taken such courses. Hence, they should be prepared to recognize the offensive content of the graphic, as should the people who decided to use the graphic as a means of ‘training.’
Assuming IBM actually used this graphic with its employees, that fact suggests contempt for the law. Ignorance of the law is reasonably ruled out because of the annual courses on Title VII.
Ideological blindness is another possible explanation. In most cases, a major corporation would be quick to recognize content that violates Title VII. But for some strange reason, the corporate eye becomes blind when the topic of discussion turns to matters related to the content of the graphic. -
Now if I were in a “Diversity Class,” and I said, “I’m not a racist, I hate all assholes, no matter what color they are,” would I be arrested or physically attacked?
Free speech is important, is it not?
