{"id":5587,"date":"2017-04-24T05:41:41","date_gmt":"2017-04-24T05:41:41","guid":{"rendered":"https:\/\/maverickphilosopher.blog\/index.php\/2017\/04\/24\/hate-speech\/"},"modified":"2017-04-24T05:41:41","modified_gmt":"2017-04-24T05:41:41","slug":"hate-speech","status":"publish","type":"post","link":"https:\/\/maverickphilosopher.blog\/index.php\/2017\/04\/24\/hate-speech\/","title":{"rendered":"Hate Speech"},"content":{"rendered":"<p><span style=\"font-family: georgia, palatino; font-size: 11pt;\"><a href=\"http:\/\/thefederalist.com\/2017\/04\/20\/sorry-college-kids-theres-no-thing-hate-speech\/\">There&#39;s no such thing<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">Glenn Reynolds <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2017\/04\/24\/free-speech-first-amendment-hate-howard-dean-glenn-reynolds-column\/100815564\/\">talks sense<\/a> against such liberal knuckleheads as Howard Dean:<\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">The other hallmark of constitutional illiteracy is the claim that the First Amendment doesn\u2019t protect \u201c<a href=\"http:\/\/www.politifact.com\/truth-o-meter\/statements\/2017\/apr\/21\/howard-dean\/howard-deans-wrong-tweet-constitution-doesnt-prote\/\">hate speech<\/a>.\u201d And by making that claim last week, Howard Dean, former governor of Vermont and Democratic presidential candidate, revealed himself to be a constitutional illiterate. Then, predictably, he <a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2017\/04\/21\/whats-the-deal-with-howard-dean\/?utm_term=.7612c45b68fb\">doubled down<\/a> on his ignorance.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">In First Amendment law, the term \u201chate speech\u201d is meaningless. All speech is equally protected whether it\u2019s hateful or cheerful.&#0160;It doesn\u2019t matter if it\u2019s racist, sexist&#0160;or in poor taste, unless speech falls into a few very narrow categories \u2014 like \u201ctrue threats,\u201d which have to address a specific individual, or \u201cincitement,\u201d which must constitute an immediate and intentional encouragement to imminent lawless action \u2014 it\u2019s protected.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">The term \u201chate speech\u201d was invented by people who don\u2019t like that freedom, and who want to give the&#0160;\u2014&#0160;completely false&#0160;\u2014&#0160;impression that there\u2019s a kind of speech that the First Amendment doesn\u2019t protect because it\u2019s hateful.&#0160;What they mean by \u201chateful,\u201d it seems, is really just that it\u2019s speech they don\u2019t agree with.&#0160;Some even try to argue that since hearing disagreeable ideas is unpleasant, expressing those ideas is somehow an act of \u201cviolence.\u201d<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">I would add that &#39;liberals&#39; have a strange tendency to conflate dissent with hate. &#0160;Obviously, if I dissent from what you maintain, it does not follow that I hate you. &#0160;And if I express my dissent in speech, it does not follow that my speech is &#39;hate speech.&#39;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">I suspect most &#39;liberals&#39; have the intellectual equipment to grasp these simple distinctions. So what ought we conclude? That they are hate-filled individuals?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino; font-size: 11pt;\">And another thing. If a liberal claims that the Great Wall of Trump is &#39;hateful,&#39; then I will put to him the question: Is it &#39;hateful&#39;&#0160;<\/span><span style=\"font-family: georgia, palatino; font-size: 11pt;\">&#0160;when you lock your doors at night? No?
