Anthony Flood<\/a> sends us to Charles Burris, Polylogism — The Root of America's Divisiveness, Decline and Destruction.<\/a><\/span><\/p>\n

History is repeating itself before our eyes. The widespread controversy surrounding President Joe Biden\u2019s Supreme Court nominee Ketanji Brown Jackson as a \u201cblack woman\u201d recalls the editorial in The Washington Times,<\/em> \u201cA Judge Too Far<\/a>,\u201d concerning President Obama\u2019s earlier nomination of Judge Sonia Sotomayor for the Supreme Court.  The editorial perceptively observed:<\/span><\/p>\n

\u201cJudge Sotomayor seems to think that inherent racial and sexual differences are not simply quirks of genetics, but make some better than others. Consider her 2002 speech at the University of California-Berkeley School of Law:<\/span><\/p>\n

\u201cI would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn\u2019t lived that life,\u201d she said. \u201cI simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.\u201d<\/span><\/p>\n

\u201cShe also accepted as potentially valid the idea that the \u201cdifferent perspectives\u201d of \u201cmen and women of color\u201d are due to \u201cbasic differences in logic in reasoning\u201d due to \u201cinherent physiological or cultural differences.\u201d<\/span><\/p>\n

The brilliant Austrian economist Ludwig von Mises, regarded as the greatest economist of the 20th Century, discussed this Marxist nonsense in his magnum opus, Human Action<\/em>, under the category of polylogism. <\/a><\/span><\/p>\n

This is the bogus idea<\/a> that the logical structure of the mind is different based on one\u2019s class, race, ethnicity, national origin, gender, sexual preference, etc.<\/span><\/p>\n

This skewed Marxist concept lies at the root of all \u201cpolitically correct\u201d notions of cultural relativism and multiculturalism fashionable in academia, the elite media, and critical race and legal theory circles today.<\/span><\/p>\n

And if President Biden has his way, upon the highest court in the land.<\/span><\/p>\n

This is more than the widely-accepted idea that our various life experiences shape our world view, or influence our value judgments in making ethical and moral decisions.<\/span><\/p>\n

Again, polylogism specifically holds that the logical structure of the mind is different based on one\u2019s class, race, nationality, gender, sexual preference, etc. There is no objective reality independent from these fixed determinative factors of causality.<\/span><\/p>\n

The notion of a Constitutionally-driven independent judicial temperament or impartiality becomes impossible.<\/span><\/p>\n<\/blockquote>\n

Did you catch the exchange between Senator Ted Cruz and nominee Jackson? <\/span><\/p>\n

"For example, I'm a Hispanic man. Could I decide I was an Asian man \u2014 would I have the ability to be an Asian man and challenge Harvard's discrimination because I made that decision?" Cruz added.<\/span><\/p>\n

Jackson replied that she could not respond to questions based on hypotheticals.<\/span><\/p>\n<\/blockquote>\n

Lord help us.  Yet another indication that leftists are mendacious to the core. <\/span><\/p>\n

All we have left is \u201csociological jurisprudence\u201d which was (is) an attempt to get away as far as possible from the Framers\u2019 original intent of the Constitution, and to adopt the doctrine of \u201cthe Living Constitution\u201d shaped by socioeconomic causal factors.<\/span><\/p>\n

It was one of the bogus concepts to come out of the so-called Progressive Era a hundred years ago and has eroded our legal system in ways beyond belief.<\/span><\/p>\n

Another way to look at it, it\u2019s the old Marxist concept of \u201cthe sociology of knowledge<\/a>\u201d applied to law and public policy.<\/span><\/p>\n

Marxism as a rationale for state aggrandizement and empire (as in the former Soviet Union) may be dead but as an ideological prop it is very much alive in such widely-accepted notions as multiculturalism, \u201ccultural imperialism,\u201d sociological jurisprudence, and environmentalism.<\/span><\/p>\n

There is much more to this fight than whether Ketanji Brown Jackson is confirmed.<\/span><\/p>\n

Her nomination is a key battle in the on-going Culture War which lies at the heart and very survival of what America is all about.<\/span><\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"
